Magnolia Municipal Court is a Safe Harbor court you will not be arrested for coming into court to take care of your citations. Our court staff is here to assist you in handling your warrants. There are two types of warrants:

A WARRANT OF ARREST IS (Texas Code of Criminal Procedure, Article 45.014)
When a sworn complaint or affidavit based on probable cause has been filed before the municipal court, the judge may issue a warrant for the arrest of the accused and deliver the same to the proper officer to be executed.
How to handle and arrest warrant:
If you have an arrest warrant you can come into set a court date with proper identification.You maybe required to place a cash bond. Please contact the court and speak with the clerk and they will be able to assist you further. For all warrants issued, the Court will add your driver’s license to the Texas Failure to Appear Program and there will be a hold placed so that you cannot renew or replace your license until this matter has been disposed of.
The second Type is a
CAPIAS PRO-FINE (Texas Code of Criminal Procedure, Article 45.045)
A Capias Pro-Fine is an order directing any Texas Peace Officer to immediately arrest a defendant and bring that defendant immediately before the court to show cause (good reason) why that person has failed to satisfy the judgment (pay their fine and court costs). Unlike an Arrest Warrant, a Capias Pro Fine is issued after a defendant has been convicted of an offense. Failure to make your appearance regarding a defaulted Driving Safety Course/Alive at 25 Course or a Deferred Disposition Order will result in a judgment rendered against you, a conviction may be reported to the Texas Department of Public Safety and may appear on your driving record. If there is any balance due on the case, a Capias Profine Warrant will be issued.

**If you are put in warrant status, you will incur additional fees. All warrants over 60 days old will be sent to a collection agency and will incur an additional 30% collection fee.**
COLLECTION AGENCIES MAY CALL YOU
If your warrant(s) or Capias Profine(s) are assigned for collection, a Private Collection Agency will contact you with information about your warrant(s) or Capias Profine(s) and how you can make payments. Be aware that your warrant(s) or Capias Profine(s) are still active even after your case(s) are assigned to a collection agency, and you are still subject to arrest until all warrants or Capias Profines are resolved.
Alternatives to Full Payment of Fines or Costs
If ordered to pay a fine and cost, and you cannot pay, notify the Court immediately. If you are determined by the Court to have insufficient resources or income to pay, the Court is required to provide you with other ways to discharge the fine and costs.
