New Fireworks Ordinance

On September 9, 2025, Magnolia City Council passed an amendment to the existing "fireworks ordinance". The executed ordinance can be accessed here: Ordinance No. O-2025-027
Summary:
- ALLOWED FOR NEW YEARS HOLIDAY:
- Person discharging must be 18 years or older
- Times: Sunset on Dec 31 to 1:00am on Jan 1. ("Sunset" by NOAA for Magnolia: 5:33pm)
- Only fireworks 1.4G allowed.
- 1.4G = Designed for combustion, deflagration, or detonation; commonly called "consumer or personal use fireworks"; classified as 1.4G by dept in 49 CFR 173 (1996); complies with US Consumer Product Safety Commission in 16 CFR 1508 (1996) requirements.
- Examples: pro line, consumer cakes, consumer reloadables, consumer rockets, crackers, fountains, sparklers, cherry bombs, M-80s, M-100s, silver salutes, those typically sold at neighborhood stands and not typically professionally discharged.
- Discharge conditions:
- 25 ft away from all structures, vehicles, and people.
- On a non-combustible surface of sufficient size to contain entire ground display area.
- Person discharging is responsible for cleaning and removing all firework debris.
- Person discharging shall comply with Texas Dept of Insurance requirements.
- Person discharging shall not be under influence of intoxicating substance.
- Person discharging shall have an extinguishment device at discharge site (ex: min. 5-gal bucket of water, min. 5-lb ABC fire extinguisher, and/or water hose)
- Discharged fireworks shall soak in water for 12 hrs before disposing in trash bin.
PROHIBITED DISCHARGE LOCATIONS:
- Multi-family residential complexes (ex: apartments)
- Within 600 ft of church, hospital, vet hospital, asylum, licensed childcare center, or public/private primary/secondary school or institution unless person received written authorization which must be submitted to the city.
- Within 100 ft of flammable liquids or flammable compressed gas storage/dispense areas.
- Within 100 ft of fireworks storage/sales.
